Lubbe v Cape Plc

Okay kiddo, imagine you have a toy factory named Cape. One day, one of the workers in your factory named Lubbe gets very sick. Lubbe thinks it's because he was breathing in dangerous chemicals while he worked in your factory.

Lubbe sues your factory, Cape, for making him sick. Now, Cape is a fancy type of company called a "public limited company" and they argue that Lubbe should sue a different part of the company that was specifically responsible for that dangerous work, instead of the whole company.

But Lubbe says that the whole company, Cape, should be responsible because they own all the different parts of the company, including the responsible part.

The court had to decide if Lubbe could sue the whole company or just a specific part of the company. The court decided that Lubbe could sue the whole company because the company had control over all its parts and could have prevented the dangerous work that made Lubbe sick.

So, in summary, Lubbe v Cape plc is about a man who got sick while working in a factory and wanted to sue the whole company, and not just a specific part of the company.
