Martens Clause

A Martens Clause is something that is written in agreements to make sure that even when something doesn't seem fair or right, everyone still gets treated fairly. It says that even if something isn't written in a contract, people still need to treat each other with kindness and respect. So if a problem comes up in a deal between two people, even if it was not written in the contract, the Martens Clause says that those people should try to work it out in a way that makes everyone happy.
