Trade dress is like the clothes a company wears to make it look special and different from other similar companies. You know how you can tell a police officer from a firefighter by their uniforms? It’s the same idea with trade dress for businesses. Companies try to make their products or stores look different and attractive to customers by using unique colors, shapes, designs, or symbols. This is called trade dress.
For example, when you see a red and yellow design on a fast food restaurant, you know it’s a McDonald's. Or when you see a bottle with a unique shape and design, you can tell it's Coca-Cola. Trade dress is a way for companies to stand out and help people recognize them easily.
But, just like you can’t wear the same exact outfit as your friend to a party, companies can’t copy each other’s trade dress. That’s because it’s against the law and could cause confusion for customers. So each company has to come up with their own unique trade dress to look special and stand out from their competition.
