ELI5: Explain Like I'm 5

Universal City Studios, Inc. v. Nintendo Co., Ltd.

Let’s pretend you’re playing a game on your Nintendo console. In this game, you control a cute little character who must jump over obstacles to reach the end of each level. However, one day, a company called Universal City Studios decided they didn’t like that Nintendo was using characters from their movies in this game. They even sued Nintendo over it!

But why did they do that? Imagine you are playing with your toy cars at your friend’s house. If your friend takes your toy cars without asking you first and starts playing with them, you might feel upset. You might even ask your friend to give your toys back to you. This is what Universal City Studios did to Nintendo.

Universal City Studios said that Nintendo was using characters from their movies, like King Kong and Godzilla, in their game without permission. Universal wanted Nintendo to stop using their characters and even asked for lots of money in compensation!

Now, Nintendo believed they did nothing wrong because they made slight changes to the characters in the game. For example, they didn’t use the exact same King Kong from the movie, they created their own version that looks a bit different. Nintendo thought they were safe to use these characters without getting into trouble.

In the end, it was up to the court to decide who was right. The court looked at the law and had to decide if Nintendo was breaking any rules by using those characters in their game. The court decided that Nintendo did not need to get permission from Universal City Studios to use the characters because they made enough changes to them. Nintendo won the case and could continue making games with different versions of those famous characters.
